
Kate Fisch’s practice focuses on commercial litigation matters, government enforcement actions, and white collar investigations.
Her client representations have spanned a variety of industries, including energy and construction, financial services, real estate finance, employment, technology, insurance, and higher education. She has extensive experience handling depositions and other pre-trial proceedings, as well as representing clients at trial and arbitrations.
Before joining Brithem, Kate was a litigation associate at Brown Rudnick, Steptoe, and Ropes & Gray. She maintains an active pro bono practice, with experience representing clients in pursuing employment and housing discrimination claims. She also serves on the Young Professional Boards of the enCourage Kids Foundation, a non-profit dedicated to improving hospital experiences for children and their families, and Children’s Specialized Hospitals, a leading provider of children’s healthcare.

Defunded sexual exploitation
For over 200 victims of child pornography, rape, and trafficking, Kate contributed to landmark lawsuits against Pornhub owner MindGeek, the world’s most dominant online pornography company in the world, financial services giant Visa, and the hedge funds that financed the business. The suit, along with the associated public advocacy and leadership, has exposed ugly truths about this industry and those supporting it and forced dramatic changes in practices.
Helped secure a $170 million trial award
For Eddystone Rail Company LLC, Kate helped it pursue fraudulent transfer claims arising from the breach of a take-or-pay contract. After a four-week bench trial in the U.S. District Court for the Eastern District of Pennsylvania, the company won a judgment of more than $170 million.
Fought against systemic racism
For the largest Black-owned asset manager in the State of New Jersey, Kate played a role in a historic civil rights and RICO action against New Jersey’s Division of Investment, BlackRock, Owl Rock, and other major financial firms challenging the systemic racism in New Jersey’s selection and allocation of capital to outside asset managers and corrupt “pay-to-play” scheme that excluded minority- and female-owned firms in favor of the “old white boy” Wall Street firms.

- A global energy company in bringing fraud and tortious interference claims in New York Commercial Division and Appellate Division in connection with a contract to construct a power plant.
- A major international financial institution in New York Supreme Court litigation related to real estate development financing transactions, involving five different nine-figure syndicated loans.
- A major financial services company in connection with several litigations and arbitrations under the Fair Credit Reporting Act, Fair Debt Collection Practices Act, and other federal and state statutes.
- Federal employee afflicted with Havana Syndrome in pursuing disability discrimination claims under the Rehabilitation Act in the U.S. District Court for the Eastern District of Virginia, resulting in favorable settlement.
- A cryptocurrency forensics consultant with respect to claims of misappropriation of trade secrets, unfair competition, and racketeering.
- The board of a leading investment firm in an internal investigation related to allegations of accounting fraud.
